1. INTRODUCTION

These Terms and Conditions (“Terms”, “Agreement”) constitute a legally binding agreement between you (“User”, “You”, “Your”) and Career Giant (“Company”, “We”, “Us”, “Our”), the owner and operator of the website https://careergiant.in (the “Platform”).

By accessing, browsing, registering, or using the Platform in any manner, including but not limited to listing services, paid promotions, submitting inquiries, or publishing content, you expressly acknowledge that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy and other applicable policies.

If you do not agree with any part of these Terms, you must immediately discontinue use of the Platform.

2. LEGAL COMPLIANCE

This Agreement is governed by and construed in accordance with:

The Platform provides:

  • College listings (free and paid)
  • Featured/promoted listings
  • User reviews and ratings
  • Inquiry/lead generation forms
  • Advertising and promotional services

IMPORTANT DISCLAIMER:
Career Giant is NOT:

  • A university or educational institution
  • An admission authority
  • A regulatory or accreditation body

We do not guarantee admissions, placements, rankings, or outcomes of any kind.

4. ELIGIBILITY

By using this Platform, you represent and warrant that:

  • You are at least 18 years old, OR using the Platform under supervision of a legal guardian
  • You have full legal capacity to enter into this Agreement
  • All information provided by you is accurate and complete

We reserve the right to suspend or terminate access if eligibility criteria are violated.

5. USER ACCOUNT AND RESPONSIBILITIES

5.1 Account Creation

To access certain features, you may be required to create an account.

You agree to:

  • Provide accurate and updated information
  • Maintain confidentiality of login credentials
  • Accept full responsibility for all activities under your account
5.2 Unauthorized Access

You must immediately notify us of any unauthorized use of your account.

6.1 Nature of Paid Listings

Career Giant offers paid promotional services including:

  • Priority placement in search results
  • Banner advertisements
  • Lead generation campaigns

These services are provided on a commercial, non-exclusive, and non-transferable basis.

6.2 No Guarantee Clause

The Company does NOT guarantee:

  • Number of leads generated
  • Conversion rates
  • Admissions
  • Business outcomes

Performance may vary depending on market conditions, user behavior, and external factors beyond our control.

7. PAYMENT TERMS

7.1 Fees

All fees for paid listings and services shall be:

  • Clearly communicated prior to purchase
  • Payable in advance
  • Non-negotiable unless agreed in writing
7.2 Payment Methods

Payments may be made through:

  • Online payment gateways
  • Bank transfer
  • UPI or other accepted methods

8. REFUND AND CANCELLATION POLICY (STRICT CLAUSE)

8.1 No Refund After One Month

STRICT POLICY:
Under no circumstances shall any refund be issued after the completion of one (1) month from the date of purchase of any paid service or listing.

8.2 Limited Refund Window
  • Refund requests (if any) must be raised within 30 days from the purchase date
  • After 30 days, all payments shall be considered final, irrevocable, and non-refundable
8.3 Non-Refundable Situations

Refunds shall NOT be granted in the following cases:

  • Dissatisfaction with leads or performance
  • Lack of expected business results
  • Change of business decision
  • Failure to utilize services
  • Delay caused by user in providing content or approvals
8.4 Processing Charges

If any refund is approved within the permitted period:

  • Applicable processing fees, taxes, and service charges shall be deducted

9. LEAD GENERATION CONSENT

By submitting any form or inquiry on the Platform, you expressly consent to:

  • Being contacted by Career Giant
  • Being contacted by listed colleges and third-party partners
  • Receiving calls, SMS, WhatsApp messages, and emails

IMPORTANT:
This consent overrides any registration under DND/NCPR.

You acknowledge that:

  • Career Giant acts as an intermediary
  • We are not responsible for how institutions use your data after lawful sharing

10. USER-GENERATED CONTENT (REVIEWS & RATINGS)

10.1 Responsibility

Users are solely responsible for content posted, including reviews, comments, and ratings.

10.2 Authenticity Clause (STRICT)

You agree that:

  • Reviews must be genuine and based on actual experience
  • False, misleading, or fabricated reviews are strictly prohibited
10.3 Prohibited Content

Users shall not post:

  • Defamatory or harmful content
  • False allegations
  • Abusive, obscene, or hateful language
  • Promotional or spam content
10.4 Enforcement

Career Giant reserves the right to:

  • Remove or edit content without notice
  • Suspend or terminate accounts
  • Initiate legal action under applicable laws

Career Giant does not verify or guarantee the accuracy of:

  • College information
  • Fees structure
  • Courses offered
  • Rankings or ratings
  • Placement statistics

All such information is provided:

  • By institutions themselves OR
  • Collected from publicly available sources

Users are advised to independently verify all information before making decisions.

12. INTELLECTUAL PROPERTY RIGHTS

All content on the Platform, including but not limited to:

  • Text
  • Graphics
  • Logos
  • Layout
  • Software

is the exclusive property of Career Giant and protected under applicable copyright and trademark laws.

Unauthorized use, reproduction, or distribution is strictly prohibited.

13. PROHIBITED ACTIVITIES

Users shall NOT:

  • Scrape or extract data
  • Reverse engineer the platform
  • Use bots or automated tools
  • Attempt unauthorized access
  • Impersonate any entity
  • Engage in fraudulent activity

Violation may result in:

  • Immediate termination
  • Legal action
  • Financial liability

14. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

Career Giant shall NOT be liable for:

  • Admission outcomes
  • Business losses
  • Loss of data or profits
  • Reliance on platform information
  • Third-party actions

All services are provided on an “AS IS” and “AS AVAILABLE” basis.

15. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Career Giant, its directors, employees, and partners from:

  • Any claims
  • Damages
  • Losses
  • Legal expenses

arising from:

  • Your use of the Platform
  • Violation of these Terms
  • Infringement of third-party rights

16. TERMINATION

We reserve the right to:

  • Suspend or terminate accounts
  • Remove listings
  • Restrict access

without prior notice if:

  • Terms are violated
  • Suspicious activity is detected
  • Required by law

17. THIRD-PARTY LINKS

The Platform may contain links to third-party websites.

We:

  • Do not control such websites
  • Are not responsible for their content or policies

Use of third-party services is at your own risk.

18. FORCE MAJEURE

Career Giant shall not be liable for failure or delay due to events beyond reasonable control, including:

  • Natural disasters
  • Internet outages
  • Government actions
  • Cyber attacks

19. MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time.

Changes shall be effective immediately upon posting.

Continued use of the Platform constitutes acceptance of revised Terms.

20. GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by the laws of India.

All disputes shall be subject to the exclusive jurisdiction of courts located in:
